How mediation can simplify post-judgment changes in Michigan

Your divorce judgment felt like the end of the matter. Then your income declined, your child’s circumstances shifted or a relocation became necessary. The prospect of returning to litigation can revive stress you assumed was resolved.

What you can change after your judgment

Michigan courts allow changes to several parts of a divorce judgment. Here’s what you should know:

  • Child custody and parenting time: Evolving developmental needs, an altered employment schedule or relocation.
  • Child support: Fluctuations in income, medical expenditures or overnight parenting time.
  • Spousal support: Adjustments where the original judgment expressly permits them.
  • Property division: Rarely reopened absent fraud, concealed assets or mutual mistake.

Most requests depend on showing that your circumstances actually changed. Under MCL 722.27(1)(c), a court cannot modify a custody order unless you show proper cause or a change in circumstances. Minor or temporary changes usually will not meet it.

Why mediation may fit these disputes

This matters because contested litigation consumes financial resources you may lack following a divorce. Judicial dockets advance slowly, and an evidentiary hearing can extend across months. Mediation frequently resolves equivalent issues in substantially less time.

Privacy is another factor. Trial records are generally public, while mediation keeps financial and family details out of that record. You also keep more control. A judge applies general standards, but you and your former spouse know your actual schedules. That knowledge can produce a parenting plan that works in practice.

Making the agreement official

An agreement reached in mediation does not change your order by itself. Michigan Court Rules require the terms to be written and signed, or placed on the record. A judge must then approve the change. Agreements that are clear and complete tend to move through that review more smoothly.

What this means for your next chapter

You now know which parts of a judgment can be revisited, what legal threshold applies and how mediation can handle those talks outside a courtroom. You also know a judge still has the final word. Understanding this process can help you protect both your parenting time and your finances during a stressful period.

Many of these disputes are resolved through family law mediation services. If your case becomes contested or complicated, our attorney can help you understand your options.
